The petitioner apprehends his arrest in Shahpur P.S. Case No. 44/15, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code and Section 3(i)(x) of the SC/ST (Prevention of Atrocities) Act.
The informant alleged that while she and others were clearing drainage some mud blown on the body of the Janki Rai and Ram Babu Rai. Thereafter they began to abuse the informant and others. The informant named 41 persons including the petitioner and alleged that all of them came and assaulted the informant and her family members.
It is submitted that there is a counter version. No specific
Patna High Court Cr.Misc. No.17226 of 2016 (2) dt.19-05-2016 2/2 allegation of assault is made against the petitioner. The informant also named one Ram Jatan Ram at Serial no. 18 who died in the year 2006 this fact itself shows the falsity of the case. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur in connection with Shahpur P.S. Case No. 44/15, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
