The petitioner has been in custody since 22.01.2018 in connection with Digha P.S. Case No. 47 of 2018 registered for the offences punishable under Sections 392/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though not named in the First Information Report, his name has surfaced in the confessional statement made before the police by one Sunny Kumar @ Vivek Kumar. It is further submitted that the looted mobile phone of the informant has been recovered from the possession of the said Sunny Kumar and not this petitioner.
