The petitioner seeks bail in a case registered for offences Sections 30 (a) and 32(2) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 242 bottles each containing 375 ml and 18 bottles each containing 750 ml of foreign liquor were recovered from the Indigo car which was being boarded by four persons including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 26.06.2017.

Considering the facts and the circumstances of the

Patna High Court Cr.Misc. No.36433 of 2017(2) dt.10-08-2017 2/2 case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Banka in connection with Katoria P.S. Case No. 99 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
