Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act.
The police apprehended the petitioner while the petitioner was driving a motorcycle and the pillion rider was carrying a rifle without licence or authority. Submission is that the petitioner had no knowledge that the pillion rider was carrying rifle without licence.
Nothing incriminating was recovered from possession of the petitioner. Petitioner is in custody since 02.01.2018. Investigation is already complete and the petitioner is ready to cooperate with the trial.
Patna High Court Cr.Misc. No.12691 of 2018 (2) dt.06-03-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chenari Police Station Case No.294 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
