Learned counsel for the petitioner submits that petitioner has filed Matrimonial Case No. 379 of 2022 against his wife respondent no. 2 for grant of decree of divorce. However, he wants to withdraw the said matrimonial case as there is settlement made between the parties in mediation. Learned counsel for the petitioner further submits that the petitioner filed the application dated 22.12.2022 for withdrawal of the said matrimonial case but no order is being passed by the learned Principal Judge, Family Court, Patna. Learned counsel for the State is present and submits that it is in the interest of justice that the application for
Patna High Court C.Misc. No.230 of 2023(2) dt.04-04-2023 2/2 withdrawal of the matrimonial case is to be decided expeditiously.
Considering the submission of the learned counsel for the petitioner and in the interest of justice, the Principal Judge, Family Court, Patna is directed to pass an appropriate order on the petition dated 22.12.2022 (withdrawal of the matrimonial case) expeditiously in accordance with law.
