JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-08-2017 The petitioner seeks regular bail in connection with Jehanabad P.S. Case No. 570 of 2016, registered for offences punishable under Sections 304B/ 201/ 34 of Indian Penal Code. Petitioner is the husband of the deceased and allegation against him is of causing dowry death of the deceased. It has been submitted on behalf of the petitioner that petitioner used to always remain ill and annoyed with the said fact deceased committed suicide by jumping before the running train. Further he has been in judicial custody for last six months. Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case and as the post mortem report is also not available on record, I am not inclined to release the petitioner on

Patna High Court Cr.Misc. No.33542 of 2017 (3) dt.04-08-2017 bail, his application for regular bail is, accordingly, rejected. However, the petitioner may renew his prayer for bail after framing of charge in this case in the court below itself and if any such application is filed, the court below after considering the materials available on record and also the submission that she has committed suicide, shall pass an appropriate order, without being prejudiced by the order of this Court.
