Petitioner, already in custody, seeks bail in connection with Belhar P.S. Case No.214 of 2017, registered under Section 379 of the Indian Penal Code.

Allegation is that 48 batteries of the mobile tower of BSNL were stolen by the petitioner and others and they were identified in flash of torch light by the informant.

Learned counsel for the petitioner submits that the alleged occurrence is dated 19.09.2017 and the petitioner is said to have been identified on the said day but the FIR was lodged after delay of two days on 21.09.2017 but there is no recovery from possession of the petitioner and charge-sheet has been submitted in this case.

No.8378 of 2018(3) dt.16-02-2018 2/2 Having considered the said facts and circumstances, petitioner Thakuri Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Belhar P.S. Case No.214 of 2017.
