JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section.147, 148, 149, 341, 354 of the Indian Penal Code, under section 3(x) (xi) of the SC/ST Act and under section 27 of the Arms Act.
The prosecution case is that when informant's wife, Shilwanti Devi, was going to field for harvesting the paddy crops, the accused persons, including the petitioner, variously armed, met her in way and started pulling her saree and misbehaved with her. On alarm being raised, her elder son came and made protest then the accused persons abused her by calling her caste name and also threatened her.
It is submitted by the learned counsel for the petitioner that accusation of assault is not against the petitioner. There is
Patna High Court Cr.Misc. No.15101 of 2016 (2) dt.12-04-2016 2/2 counter version of the occurrence and the petitioner's side, at earlier point of time, lodged Azimabad P.S. case No. 67 of 2015 against the informant's side. It is further submitted that no one has received any injury.
Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for six months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM-I, Bhojpur, Ara in connection with Azimabad P.S. Case No. 68 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioner shall be confirmed by the learned court below on verification of the fact that informant's side have not received any grievous injury, but if it is found that the informant's side received grievous injury, then the petitioner shall surrender and pray for regular bail.
