JUSTICE ARUN KUMAR ORAL ORDER 14-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Shikarpur P.S.Case No. 440 of 2017 registered under Sections 302/34 of the Indian penal Code and Section 27 of the Arms Act.
Submission is that FIR is against unknown and petitioner is implicated merely on the basis of suspicion and confessional statement that he helped the killers in identifying the deceased and except that there is no other material.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Pawan Ojha, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Bettiah, District- West Champaran in connection with Shikarpur
