2. The petitioner seeks bail registered for the offence under Section 394 and 412 of the Indian Penal Code and Sections 27 of the Arms Act.

3. As per the prosecution case that the father of the informant was fired by three unknown miscreants with an intention to kill him and took away his bag containing a lunch box and some important documents.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next submits that the charge has been framed in this case on 14.04.2023 but up till now no witness has been turn up in this

Patna High Court CR. MISC. No.19746 of 2024(2) dt.27-03-2024 2/2 case. He next submits that similarly situated co-accused persons have been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 13374 of 2024 and he is in custody since 20.10.2022.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances of the case, let the petitioner, above named, be directed to be released on bail in connection with Buddha Colony P.S. Case No.418 of 2022 (S.T. Case No. 655 of 2023) on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-IV, Patna, District- Patna with following conditions:- (i) One of the bailors shall be own/close member of the family of the petitioner.

(ii) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
