JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-05-2022 Heard Ms. Nilima Sinha, learned Advocate for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Chandi P.S. Case No. 38 of 2020 dated 01.02.2020 instituted for the offences under Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code. An occurrence had taken place post celebrations of Saraswati Puja in which the petitioner is said to have assaulted one Rohit, whose injury has not been placed on record. The informant though has also received injuries but that is not attributable to the petitioner.

Case No. 42 of 2020, which has been lodged by one Kushal Singh against the informant and others in which case, the accused persons have been granted anticipatory bail. Considering the afore-noted background facts and the nature of accusation against the petitioners as also taking into account that they do not have criminal records, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chandi P.S. Case No. 38 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
