JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2016 The present application has been filed for quashing the order dated 03.05.2003 passed by the learned CJM, Kishanganj in connection with Complaint Case No. 345 of 2003 whereby by process has been directed to be issued after cognizance being taken for the offences punishable under Sections 406 and 420 of the IPC.

It appears that for the same relief, earlier also Cr. Misc. No. 17421 of 2003 which was disposed of by a co-ordinate Bench of this Court (now retired) with observation to raise the contentions at the stage of discharge under Section 245 Cr. P.C.
