JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is father-in-law of the deceased, seeks bail in connection with Nabinagar P.S. Case No. 298 of 2019 dated 04.11.2019 instituted for the offences under Sections 498A, 326, 307/34 and 304(B) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The petitioner is stated to be in custody since 05.11.2019.

It has been submitted on behalf of the petitioner that from the reading of the FIR itself, it would appear that only because the petitioner happens to be the father of the husband of the deceased, he has

Learned counsel for the petitioner has submitted that the deceased caught fire while cooking food in her house. The petitioner, for all practical purposes, has been residing separately from the husband of the deceased.

The husband of the deceased is in custody since 10.10.2020.

Considering the aforestated facts viz. that the husband of the deceased is in jail and the petitioner has remained in jail since 05.11.2019, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Aurangabad in connection with Nabinagar P.S.
