Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Asarganj PS case no. 48 of 2024 dated 16.03.2024, disclosing offences punishable under Sections 341, 323, 366, 365, 378, 419, 420, 471, 120-B/34 of the Indian Penal Code and Section 27 of Arms Act.

The prosecution story, as per the First Information Report, is that on 22.06.2023, the petitioner being the friend of the complainant/ informant took the complainant to marriage ceremony at village Khiridih, where his marriage was forcibly solemnized with the daughter of co-accused Sanjay Singh
Patna High Court CR. MISC. No.16626 of 2025(2) dt.06-03-2025 2/3 namely Sarswati Kumari. On 30.11.2023, petitioner along with others came to the house of the complainant/ informant and told that if Sarswati Kumari was not kept in the matrimonial home, they would kill the complainant/ informant and his family members.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case in order to harass him. Learned counsel further submits that the complaint was subsequently converted into First Information Report under Section 156(3) Cr.P.C. The marriage was solemnized after negotiation but the complainant/ informant was not allowing his wife to stay with him. He next submits that there is delay of almost 05 months in filing of the complaint and it has not properly been explained. The petitioner is stated to be having no criminal antecedent.

Regard being had to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the justification given by the learned counsel for the petitioner, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his
Patna High Court CR. MISC. No.16626 of 2025(2) dt.06-03-2025 3/3 arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Munger in connection with Asarganj PS case no. 48 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
