JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-04-2016 Heard learned counsels for the petitioners and the State. The petitioners being mother and second wife of husband of husband of complainant are apprehending arrest in a case registered for the offences punishable under Section 323, 494, 498(A) of the Indian Penal Code.
The basic accusation is of torture.
It is submitted by the learned counsel for the petitioners that thrust of accusation is against husband of the complainant and there is omnibus and general allegation against the entire in-laws family. The petitioner No.1 claims to be separate from the husband of complainant. It is submitted on behalf of petitioner No.2 that she was not aware of the fact of earlier marriage of her husband.

No.15960 of 2016 (2) dt.11-04-2016 2/2 Considering that thrust of accusation is against the husband and the petitioners being ladies, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Sujit Kumar, learned JM, 1st class, Nawada in connection with Complaint Case No. 982 of 2015, Trial No. 1229 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
