The petitioner seeks bail in a case registered for offences under Sections 30(A) and 30(D) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 23 litres of country-made liquor were recovered from the bag which was carried by co-accused Dharmendra Kumar who has been granted bail by the court below on whose confession the petitioner has been made accused in this case. Petitioner claims that he is having clean antecedent and is in custody since 15.06.2017.

Patna High Court Cr.Misc. No.36285 of 2017(2) dt.10-08-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-VIcum-Special Judge, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 37 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
