Learned counsel for the petitioner, at the outset, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.3.

Permission is accorded.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 324, 325, 307, 447 and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that rest of

No.24956 of 2021(5) dt.16-11-2022 2/3 the petitioners have antecedent of one case and the informant alleges that on 15.11.2020 at about 8:00 AM, while he was working in his field when the accused persons, including the petitioners, along with other co-accused came and started assaulting him, it is next submitted that he was assaulted by spade and lathi causing injury on head, further he also suffered fracture of his left hand and cut injury in the finger of right hand.

Learned counsel for the petitioners submits that from bare perusal of allegation as alleged in the FIR, it would manifest that the allegation of assault is general and omnibus in nature, it is next submitted that on account of dispute relating to land the present occurrence is alleged to have taken place, it is also submitted that the injury suffered is simple in nature, but then one of the injuries over right little finger is said to be grievous which is not on vital part of the body. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioner nos. 1 and 2, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on
