JUSTICE ARUN KUMAR ORAL ORDER 27-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bahadurpur P.S.Case No. 497 of 2017 registered under Sections 323, 341, 376, 504, 506 and 509/34 of the Indian Penal Code.

Submission is that there is admitted enmity between both sides and a proceeding under Section 107 Cr.P.C. also was initiated in between them and prosecutrix is a married lady and the case was lodged after delay of one day without any explanation and in medical examination no sign of rape or any injury on her person was found.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Om Sahani @ Sahni, is directed to be released on bail upon furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.11274 of 2018 (2) dt.27-02-2018 2/2 10,000/- with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Darbhanga in connection with Bahadurpur P.S. Case No. 497 of 2017.
