JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody in connection with Bhabua P.S. Case No.617 of 2017, a case under Sections 363/363A of the Indian Penal Code. Though cognizance has been taken against the petitioners under Section 364 of the Indian Penal Code.

Co-accused Ramshakhi Dom is alleged to have kidnapped to the son of the informant in his presence and subsequently committed murder.

Submission is that Ramshakhi Dom has confessed

Patna High Court Cr.Misc. No.12910 of 2018 (3) dt.18-04-2018 P2/ before the police that he has committed murder. However, only material against the petitioners is suspicion that they were involved in managing the said occurrence.

Considering the nature of material against the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bhabua Police Station Case No. 617 of 2017, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
