1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. On query of the Court from the learned counsel for the petitioner with respect to the stage of the case, as the present quashing application has been filed seeking quashing of the order dated 10.02.2016 whereby the discharge application of the petitioner was rejected by Shri Rajesh Kumar, the learned Additional District and Sessions Judge-VI, Bhojpur at Ara in S.T. No. 94 of 2014 arising out Udwant Nagar P.S. Case No. 143 of 2010, the learned counsel for the petitioner submits that despite his best endeavours, he could not seek instruction from the petitioner.
3. Shri Chandra Bhushan Prasad, the learned A.P.P.
Patna High Court CR. MISC. No.18671 of 2016(2) dt.11-09-2023 2/2 for the State submits that in the event, if the Court interferes with the order by which the discharge application of the petitioner had been rejected and the charges if framed, the trial would have commenced, in that event, the entire effort of this Court would go futile.
4. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to entertain the quashing application.
