JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks regular bail in connection with Special Case No. 80 of 2016 arising out of Salimpur P.S. Case No. 138 of 2016 registered for the offences punishable under sections 20/22 of the N.D.P.S. Act Earlier the prayer for regular bail was rejected vide order dated 27.03.2017 passed in Cr. Misc. Case No. 13951 of 2017 by this Court with a direction to the trial court to expedite the trial and try to conclude it as soon as possible but the trial court has not taken necessary step and till today the case is pending for hearing on the point of charge.

Learned APP opposes the prayer for bail.

Patna High Court Cr.Misc. No.35383 of 2017 (2) dt.02-08-2017 2/2 Having heard both sides, in view of the facts and circumstances, I am not inclined to enlarge the petitioner on bail and accordingly his prayer stands rejected.

However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of nine months and at the same time the Superintendent of Police, Patna is directed to ensure the attendance of witnesses in the court on the date fixed so that the trial can be concluded with the said period.

With the above observation, this application is dismissed.
