JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 406/420 of the Indian Penal Code.
As per prosecution case, the petitioner is said to have taken Rs. 3,60,000/- from the informant for sending his brother and his friend Arun Kumar abroad. Arun Kumar was sent to Melesiya on wrong Air ticket as well as Visa where he was apprehended by Malesiya police and was sent back to India. On putting pressure the petitioner executed an agreement to return Rs. 1,60,000/- to the informant but he even did not return the said amount.
It is submitted on behalf of the petitioner that he has not taken any money from the informant. There is no evidence of taking money by the petitioner and there is no such agreement of
Patna High Court Cr.Misc. No.33992 of 2017 (2) dt.20-07-2017 2/2 returning the money by the petitioner. The present case has been lodged after inordinate delay of five months. The petitioner is in custody since 05.06.2017.
Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., (10),Siwan in connection with Siswan ( M.H.Nagar) P.S.Case No. 105 of 2016.
