The petitioner, already in custody, seeks bail in connection with Tariyani P.S.Case No. 12 of 2018 registered under Sections 25(1-b)a/26/35 of the Arms Act. Allegation in brief is that one country made loaded pistol was recovered from the possession of the petitioner. Submission is that petitioner is in custody since 04.02.2018 and had only one criminal antecedent but subsequently has been made accused in a case registered under Section 392 of I.P.C.

Having considered the very short period of custody and the criminal antecedent of the petitioner, his prayer of bail is rejected. Trial court is directed to expedite the trial and conclude the same preferably within six months. If the same is not concluded within stipulated period, petitioner may renew his

Patna High Court Cr.Misc. No.25923 of 2018(2) dt.02-05-2018 2/2 prayer of bail.
