The petitioner has been in custody since 22.05.2017 in connection with Tajpur P.S. Case No. 237/2012 registered for the offences punishable under Sections 384/307/365/440/34 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that he along with others exploded a bomb and took away the informant's son. However, even as per the First Information Report, there is no specific overtact attributed to the present petitioner. Learned counsel for the petitioner further submits that the victim boy after his recovery in his statement under Section 164 Cr. P.C. has not named the present petitioner.
