The petitioner seeks bail in a case registered under Sections 341, 323, 364, 506, 302, 201 & 120B of the Indian Penal Code.

The prosecution case in brief is that while the informant along with his son departed from his house for bringing domestic goods, in the way, the accused persons kidnapped the informant's son and in consequence thereof, the son of the informant was killed and his dead body was thrown near the house under construction.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-03-2019. It is a

Patna High Court CR. MISC. No.15313 of 2020(2) dt.03-03-2020 2/2 case of last seen. There is no eye witness to the alleged occurrence. The other co-accused with similar allegation have been granted bail by coordinate benches of this court vide Annexure-3 series.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-Ist, Barh in connection with Sessions Trial No. 1021 of 2019.
