2. The petitioner has preferred this application for grant of regular bail in connection with Danapur P.S. Case No. 1246/2024 dated 10.12.2024 registered for the offences punishable u/s 30(a) and 41 of the Bihar Prohibition and Excise Act and Sections 25(1-B)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, total 2582.73 litres of illicit foreign liquor was recovered from the godown of the petitioner. Three cars, two motorcycles, one pistol and 10 live cartridges were also recovered from the spot.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and have falsely been implicated

Patna High Court CR. MISC. No.13877 of 2025(2) dt.05-03-2025 2/2 in this case. The petitioner is not owner of the said vehicles. The petitioner has no concern with the alleged recovery. Nothing has been recovered from the possession of the petitioner. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 12.12.2024. The co-accused has been granted regular bail by this Court vide order dated 28.02.2025 passed in Cr. Misc. No. 12230 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur, Patna, in connection with Danapur P.S. Case No. 1246/2024.

7. The application stands allowed.
