The petitioner apprehends his arrest in Singhia P.S. Case No. 181 of 2014, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code. The name of the petitioner figured at Serial no. 3 in the fardbeyan of Uttam Yadav who disclosed that the accused persons surrounded him in front of the house of the Ganeshi Yadav. Ranjit Yadav with hockey stick and Umesh Yadav with Farsa assaulted to Baidyanath Yadav. On alarm, Mahesh Yadav, Umesh Yadav, Babloo Yadav, Arun Yadav, Dinesh Yadav came to save the informant but Umesh Yadav with Farsa and Ganeshi Yadav with iron rod assaulted Mahesh Yadav and badly injured him.

No.19070 of 2015 (3) dt.02-07-2015 Thereafter, Gayanand Yadav, Mukesh Yadav, Nitish Yadav and other accused persons are alleged to have assaulted Dinesh Yadav and Umesh Yadav and they succumbed to injury. It appears that Umesh Yadav and Ramesh Yadav had assaulted Jagarnath Yadav and on inquiry this occurrence took place but from perusal of the entire allegation, the informant has not made any specific allegation of assault against the petitioner, although, his name is mentioned.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Rosera, Samastipur in connection with Singhia P.S. Case No. 181 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
