JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.
The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(A) of the Excise Act. Learned counsel for the petitioner contends that allegedly the police recovered country made mahua liquor in two containers from the motorcycle. As per the prosecution case the petitioner was nor there, but villagers are said to have told that it was the petitioner, who had left the motorcycle abandoned with mahua liquor.
It is submitted by the learned counsel for the petitioner that there is nothing to show that the recovered motorcycle belongs to him. He has also stated that petitioner
Patna High Court Cr.Misc. No.18983 of 2015 (2) dt.02-07-2015 has no criminal antecedent.
In view of the submission as above, let above named petitioner in the event of his arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gaya, in connection with Fatehpur P.S. Case No. 157 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
