JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kotwali P.S.Case No. 395 of 2017 registered under Sections 302/34 of the Indian penal Code and 27 Arms Act. Allegation in brief is that suspicion is raised against the petitioner by the deceased's husband to have killed his wife as earlier she has eloped with the petitioner.

Submission is that during investigation it transpires that it was husband, the informant of the case, who killed his wife and falsely implicated the petitioner so he has not been sent up for trial and instead of FIR named accused persons, deceased husband and his family members have been charge sheeted.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Tinku @ Ravish is directed

Patna High Court Cr.Misc. No.6224 of 2018 (3) dt.09-02-2018 2/2 to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Kotwali P.S. Case No. 395 of 2017.
