JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-03-2020 The petitioners who are in custody since 27.12.2019 seek bail in connection with Sour Bazar P.S. Case No. 497 of 2019 instituted for the offences under Sections 341, 323, 342, 307, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. It has been alleged by the informant that he was accosted by the petitioners and one Sushank Shubham @ Sonu Singh fired at him leading to injuries on his person. The old enmity with respect to a temple is said to be the cause of occurrence.

The learned counsel for the petitioners has

Patna High Court CR. MISC. No.13239 of 2020(2) dt.02-03-2020 2/2 submitted that except of the petitioners being named in the F.I.R, there is no specific accusation of any assault by them. Even the injury report which has been brought on record as Annexure-3 reflects that there was one connecting injury.

Considering the aforestated facts viz period of custody of the petitioners and also taking into account the past enmity and clean antecedents, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) each with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 497 of 2019.
