13-02-2018 Heard Sri Lal Bahadur Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is owner of a tractor, has approached this Court with a prayer to grant anticipatory bail in Rafiganj P.S. Case No. 214 of 2017 registered for offence under Sections 379, 411/34 of the Indian Penal Code and Sections 4/40 of Bihar Minor Mineral Concession Rules, 1972. It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the present case. Besides hearing, I have also perused the material on record, particularly the F.I.R., and after going through the same, I am of the opinion that it is a fit case for extending the privilege of anticipatory bail.
Accordingly, in the event of arrest or surrender within a
Patna High Court Cr.Misc. No.7385 of 2018(2) dt.13-02-2018 2/2 period of six weeks from today, let the petitioner namely Devendra Kumar Singh be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 214 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
