Petitioners are an accused in connection with Saharsa Sadar P.S. Case No. 1048 of 2019 for the offence registered under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the instant case. It is further submitted that there is land dispute between the parties with regard to partition of land. It is further submitted that deceased had lodged a case against the informant under Sections 376, 307 and other sections of the Indian Penal Code bearing
Patna High Court CR. MISC. No.15202 of 2020(2) dt.03-03-2020 2/2 Simri Bakhtiyarpur P.S. Case No. 15 of 2011 in which the learned Court below took cognizance against the informant under Sections 376 and 307 of the Indian Penal Code. It is further submitted that the specific allegation is against Roshan Kumar and not against the present petitioner and he is in custody since 26.11.2019.
Having considered the above facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 1048 of 2019.
