The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 506 and 504 of the
Patna High Court Cr.Misc. No.15228 of 2016 (2) dt.12-04-2016 2/3 Indian Penal Code.
The prosecution case is that on 23.10.2015 at 8.00 P.M. petitioner no. 1 Kani Lal Mahto intoxicated condition dashed wooden cart of the informant as a result daughter of the informant fell down which led to scuffle and then the accused persons assaulted the informant side and snatched rupees ten thousand.
It is submitted by learned counsel for the petitioners that for a petty dispute the accusation has been levelled. The injuries of the informant side have been found to be simple in nature and several persons of the petitioners' have also received injuries. The case lodged by the petitioners' side is at earlier point of time and for the occurrence of 23.10.2015 at 8.00 P.M. the FIR was registered on 24.10.2015 at 4.15 P.M. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the case lodged by the petitioners' side at earlier point of time and the genesis of the occurrence, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each
Patna High Court Cr.Misc. No.15228 of 2016 (2) dt.12-04-2016 3/3 with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No. 309 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
