The petitioners apprehend their arrest in Bahera P.S. Case No. 338/2014, registered for the offence punishable under Sections 406, 420 of the Indian Penal Code.

The informant, Block Development Officer, Benipur made surprise inspection and alleged that petitioner no. 1 Poonam Kumari was entrusted with Rs. 2,50,000/- for distribution of pension among old age pensioners, but the pensioners disclosed that they got Rs. 1,750/- only instead of Rs. 1,800/-. It is submitted that petitioners are husband and wife. Husband was assisting the wife in distribution of pension. All the signatories have stated that they received the entire amount of

Patna High Court Cr.Misc. No.16710 of 2016 (4) dt.05-07-2016 2/2 pensions and given in writing and on affidavit that no such deduction was made from their pension.

Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Benipur in connection with Bahera P.S. Case No. 338/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
