Petitioner apprehends his arrest in connection with Muffasil P.S.Case No. 253 of 2017 registered for the offences punishable under Sections 379, 353, 332, 333, 307, 147, 148 and 149 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is of assault to the police party when they have come to raid the tractors of the petitioner.
Submission of learned counsel for the petitioner is that five persons have been made accused in this case and there is no specific allegation attributed against the petitioner and whole prosecution case is false and concocted. Further submission is that co-accused Mandal Yadav has already been granted the privilege
Patna High Court Cr.Misc. No.13032 of 2018 (2) dt.04-04-2018 2/2 of anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc.No. 8166 of 2018 vide order dated 17.2.2018. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Muffasil P.S.Case No. 253 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
