Petitioner is languishing in custody since 02.09.2016 in connection with Sabour P.S. Case No. 148/2016 for offences punishable under Sections 25(1-b) a, 26 of the Arms Act. The prosecution case, as lodged by the police personnel, is that on information that a veteran criminal Teta Mandal along with his associates was roaming in the village, the police party apprehended the petitioner along with co-accused Teta Mandal. From the possession of the petitioner one countrymade pistol and three live cartridges was recovered. It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.34704 of 2017 (2) dt.10-08-2017 2/2 petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated in the aforesaid case. He submits that no overt act has been committed by the petitioner and that chargesheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record and the period of custody, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-Xth, Bhagalpur, in connection with Sabour P.S. Case No. 148/2016. (Nilu Agrawal, J) Rajesh/- U T
