16-06-2015 Heard Sri Bhavesh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who was husband of sister of the informant, apprehending his arrest in connection with Nardiganj P.S. Case no.136 of 2014 registered for the offence under Section 306, 34 of the Indian Penal Code, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner by way of referring to F.I.R. submits that admittedly the death of the deceased had occurred at the place of the informant's house. He submits that the marriage of the deceased was solemnized with the petitioner six years back. She was not blessed with any child. It appears that she has committed suicide. Patna High Court Cr.Misc. No.19415 of 2015 (2) dt.16-06-2015 2/2 mother-in-law and father-in-law have already been granted anticipatory bail by this Court on 21.01.2015 vide Cr.Misc.No.2844 of 2015.
In view of the facts and circumstances, particularly the fact that death had taken place at the informant's house, the Court considers that it is a fit case for extending the privilege of anticipatory bail to the petitioner. Let the petitioner, namely, Ramjanam Chouhan @ Ram Janam Chauhan, in the event of his arrest or surrender within a period of one month from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nawada in connection with Nardiganj P.S. Case no.136 of 2014 subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U
