Petitioner, already in custody, seeks bail in connection with Kako P.S. Case No.188 of 2017, registered under Sections 379, 411, 413 and 414 of the Indian Penal Code.

Allegation in brief is that stolen motorcycle was recovered from possession of one Santosh Kumar and he disclosed that the motorcycle was given to him by Suraj Kumar and Suraj Kumar disclosed that motorcycle was given to him by Manish Kumar, who disclosed that this petitioner has given the motorcycle. Learned counsel for the petitioner submits that except confessional statement made by the co-accused that motorcycle was given by the petitioner, there is no other material; petitioner has no criminal antecedent rather the motorcycle was recovered

Patna High Court Cr.Misc. No.8424 of 2018(2) dt.12-02-2018 2/2 from one Santosh Kumar and he has been admitted to bail by a coordinate Bench of this Court by order dated 16.11.2017, passed in Cr. Misc. No.53361 of 2017 and the petitioner is in custody since 14.12.2017.

Having considered the said facts and circumstances, petitioner Sunny Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-4, Jehanabad in connection with Kako P.S. Case No.188 of 2017.
