The petitioner is languishing in custody since 11.10.2018 in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
The prosecution case is that on 28.03.2018 informant's Rs.29,25,516/- was robbed by motorcycle borne miscreants, leading to registration of the FIR against unknown. The name of the petitioner sprang up on the confession of coaccused Dharmendra Yadav and Suresh Yadav wherein they admitted that the petitioner also participated in the commission of the offence. During investigation, it transpired that the petitioner is active member of robbers group team. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.14063 of 2019(2) dt.07-03-2019 2/2 that neither there is any recovery from the petitioner nor has he been put on T.I. Parade. It is further submitted that the petitioner is accused in another case in which he is on bail. Learned APP submits that the name of the petitioner sprang up on confession of co-accused.
Considering the fact that the investigation has already been concluded and the material on record does not suggest any recovery from the petitioner, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwantnagar (Gajrajgani) P.S. Case No. 97 of 2018.
