JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kuchaikot P.S. Case No. 04 of 2017 instituted for the offence under Sections- 272, 273, 420 of the Indian Penal Code and Section-30(a)(b)(c) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that the police party intercepted the truck, of which, the petitioner was the driver and on search, 3540 bottles of Royal Stag Whiskey containing 750 ml. each, 1200 bottles of Mc Dowell No. 1 containing 750 ml each and 2400 bottles of Officer Choice containing 180 ml. each of foreign liquor kept in cartons covered with 217 bags of potatoes were recovered from the aforesaid truck. This petitioner disclosed that one Sonu of Ludhiyana has got loaded the truck and he had directed to deliver the wine first to co-accused Munna Singh and then to deliver the same to Sonu Singh and Ajay Rai also.

Patna High Court Cr.Misc. No.37874 of 2017 (2) dt.09-08-2017 From the statement made in the written report and the seizure list, it appears that petitioner was indulged in carrying illegal business of contraband liquor in huge quantity in collusion with other accused persons.

In such circumstances, this court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail is rejected.

The petitioner is given liberty to renew his prayer for bail in the court below itself after six months if no substantial progress is made in the case in court below.
