JUSTICE SHIVAJI PANDEY ORAL ORDER 24-11-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking regular bail in connection with Sarai P.S. Case No. 433 of 2019 registered for offence punishable under section 414 of the Indian Penal Code and sections 30 (a)/35 (a) of the Bihar Prohibition and Excise Act, 2018.

A huge quantity of liquor has been recovered from a truck and the petitioner is driver of the said truck. Learned counsel for the petitioner submits that the petitioner is in custody since 23.12.2019.

Looking to the period of custody, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 2nd

Case No. 433 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found to be involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of his bail bond and the court below will pass an appropriate order.
