====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Alam Nagar P.S. Case No. 144 of 2015, registered for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code. On the basis of private complaint lodged by Junior Alam @ Md. Junaid, this case has been registered with allegation that petitioners have withdrawn the amount of Indira Awas Scheme after violating the rules and norms and they have misappropriated that amount.

Submission is of false implication and that petitioner nos. 1 to 7 have taken the amount of Indira Awas Scheme after thorough investigation and verification and they constructed Indira

The petitioner no.8 have never got any amount of Indira Awas Scheme and all allegations leveled against him is false and concocted. There is no legal and tangible material against the petitioners and the complainant has lodged this case with entirely false and baseless allegation. The learned A.P.P. submits that the petitioners have alleged in para 10 of the bail petition, that petitioner nos. 1 to 7 have constructed the Indira Awas Scheme and living in the said house and petitioner no.8 have never got any amount of Indira Awas Scheme.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Uda-Kishunganj, in connection with Alam Nagar P.S. Case No. 144 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.)
