=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 15-12-2016 Heard learned counsel for the petitioner. Nobody appears on behalf of the State.

The prayer in the writ petition is for quashing the notice issued in Case No. 200 of 2013-14 by the respondent no. 3, under the Bihar Land Disputes Resolution Act, 2009, by which the petitioner has been asked to appear.

In the considered opinion of the Court, there cannot be any occasion to interfere in the matter when only a notice has been issued for a party to appear before the Authority.

Patna High Court CWJC No.10815 of 2014 dt.15-12-2016 2/2 Faced with the situation, learned counsel for the petitioner prays that he may be permitted to withdraw the writ application so that he may appear in the case with liberty to approach the appropriate forum, in accordance with law, if any order adverse to his interest is passed in Case No. 200 of 2013-14. In view of the aforesaid, the writ application stands disposed off as withdrawn with the liberty aforesaid. In case the petitioner appears pursuant to the notice impugned, within three weeks from today, along with a copy of this order, the case would be heard and decided on merit.
