The petitioners seek bail in anticipation of their arrest in connection with Agiaon Bazar P.S. Case No. 131 of 2019, dated 13.09.2019, instituted for the offences under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.

No.25633 of 2021(2) dt.25-05-2022 2/3 The petitioner No. 1 is the own brother of the informant of this case who is alleged to have caught hold of the victim when petitioner No. 2, who is the son of petitioner No. 1, is said to given a tangi blow on Pradeep Kumar. It has been submitted on behalf of the petitioners that there is no accusation of assault or any overt act against petitioner No. 3 except for her being part of the mob when the occurrence had taken place. It has further been submitted that there is a counter version of the occurrence as well lodged by petitioner No. 2.
There have been injuries from both sides, but none of the injuries are reported to be grievous.
Regard being had to the background facts, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur (Arah) in connection with Agiaon Bazar P.S. Case No. 131 of 2019,
Patna High Court CR. MISC. No.25633 of 2021(2) dt.25-05-2022 3/3 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
