Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 447, 504, 506 and 34 of the Indian Penal Code. 3.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and informant alleges that on 25-5-2022 when she was at her home when Pradeep Ram called her son by name and asked him to accompany him to a fair and when the son of the informant

Patna High Court CR. MISC. No.17074 of 2024(2) dt.04-04-2024 2/3 refused, he was dragged out of the house by wrapping a towel around his neck by Pradeep Ram. It is next alleged that Pradeep, Ramayan and Vikash assaulted the son of the informant by sword and farsa causing injury on his head and when Ravikishan came to pacify the matter he was assaulted by Raja, Rajdhani, Jaimala and Bhubaneshwar.

The learned counsel submits that the informant alleges that her son was assaulted by fersa and sword on head causing injury, but from perusal of the order impugned, it would manifest that the injury is simple caused by a hard and blunt substance. It is next submitted that the petitioner vehemently denies the allegation but then even presuming what has been alleged is true without admitting then the injury found is simple in nature and is alleged to have been caused by a hard and blunt substance when the allegation is of assault by sharp substance. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners and the fact that petitioners are persons with clean antecedent, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.17074 of 2024(2) dt.04-04-2024 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pipra P.S. Case No. 163 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
