The petitioner is languishing in custody for the offences punishable under Sections 420/379/34 of the Indian Penal Code and Rule 4 and 40 of the Bihar Minor Mineral Concession Rules, 1972 and Rule 8(d) of the Bihar Minor Mineral (Prevention of Illegal Mining, Transportation Storage) Rules, 2003. Petitioner is driver of the truck, which was carrying sand, a forest material. Petitioner is in custody since 21.03.2018.
Considering the nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the
Patna High Court Cr.Misc. No.27452 of 2018 (2) dt.07-05-2018 P2/ like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Islampur P.S. Case No.87 of 2018, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
