The petitioner apprehends his arrest in Special Case No. 6061/19 (Arising out of Gopalpur P.S. Case No. 194/2019) registered for the offence under Sections 147/148/149/353/332 of the Indian Penal Code and Sections 30A/40 of Bihar Prohibition and Excise Act 2016.

As per prosecution case 26 litres of country made liquor is said to have recovered from the house of co-accused, namely, Moti Paswan and Soti Paswan.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of petitioner. The petitioner has falsely been implicated in this case only on the basis of suspicion. It is further submitted that the petitioner has clean antecedent.

No.13253 of 2020(2) dt.04-03-2020 2/2 Considering the aforesaid facts and circumstances as well as nature of accusation, in the event his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Special Case No. 6061/19 (Arising out of Gopalpur P.S. Case No. 194/2019), subject to the conditions as laid down under Section 438(2) of Cr.P.C.
