Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414/34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
A pistol and a cartridge was allegedly recovered from possession of the petitioner and he was arrested on suspicion that the petitioner and others were making preparation to commit dacoity. Petitioner is in custody since 07.10.2020. Investigation of the case against the petitioner is already complete. There is only one case against the petitioner which is under the Bihar Prohibition and Excise Act, 2016. Considering the nature of material against the

No.25267 of 2021(2) dt.13-09-2021 2/2 petitioner and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gaighat Police Station Case No. 320 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
