JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-11-2019 The petitioners seek quashing of the order dated 10.12.2014 passed by the learned Judicial Magistrate 1st Class, Biharsharif, Nalanda in connection with Complaint Case No. 919 C of 2014, whereby cognizance has been taken under Sections 323, 420, 465, 467, 468, 471 and 504/34 of the Indian Penal Code.

After some arguments, Mr. Mahendra Thakur, learned advocate for the petitioners seeks permission to withdraw this petition in order to enable the petitioners to approach the court below at an appropriate stage of Section 245 Cr.P.C.

Should such a petition be filed before the court

Patna High Court CR. MISC. No.21560 of 2015(3) dt.22-11-2019 3/3 below, the same shall be disposed of in accordance with law without being prejudiced by the fact that the present petition has not been entertained.
