Heard learned counsel for the petitioners and learned A.P.P for the State.
The petitioners seek bail in Chanpatia P.S. Case No. 57 of 2011 corresponding to Trial No. 1820 of 2020, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 379, 504, 506 of the Indian Penal Code. It is a case of misuse of privilege of bail in which the bail bonds of the petitioners were cancelled on 09.08.2011 and processes were ordered to be issued and thereafter they were arrested and taken into custody on 09.01.2021. Patna High Court CR. MISC. No.26080 of 2021(3) dt.13-09-2021 2/2 court reveals that appearance of all the four accused persons could be secured by 25.06.2021 and charges have been framed on 16.09.2013 and the record was fixed for the evidence on behalf of prosecution.
Considering the conduct of petitioners, I am not inclined to enlarge the petitioners above-named on bail. Accordingly, the same is rejected.
However, trial court is directed to conclude the trial as early as possible.
